Which FSSAI registration or licence may apply?

Basic registration, State licence or Central licence?

A higher category is generally indicated where you

  • operate at a turnover or production capacity above the limits prescribed for the lower category
  • operate from premises in more than one State
  • import or export food products
  • supply to Central Government agencies, railways, airports or seaports
  • operate a large manufacturing unit or a proprietary-food manufacturing activity
  • operate an e-commerce food business covered by the regulations

Basic registration is typically the starting point where you

  • are a petty food business operator within the prescribed turnover limit
  • run a small retail outlet, stall, or home-based food operation within the limits
  • operate from a single State with modest production or handling capacity
  • have just started and expect turnover below the threshold for the first year

Category applicability depends on turnover, installed capacity, kind of business and the States you operate in — several of which are prescribed by regulation and change. This is an orientation. Your actual category is confirmed after we review your operations, and it is stated in writing before any application is filed.

What an FSSAI licence actually is

Every food business operator in India — manufacturer, processor, packer, storage unit, transporter, distributor, retailer, restaurant, cloud kitchen, caterer, importer or e-commerce food seller — needs registration or a licence under the Food Safety and Standards Act. What differs is the category: petty operators take Basic registration, mid-sized businesses take a State licence, and larger, multi-State, import-export or specified businesses take a Central licence. The outcome is a 14-digit FSSAI number that must be displayed and, in prescribed cases, printed on labels.

    Your licence records the specific kinds of business you carry on. Doing an activity not on your licence is a compliance gap.

    Licensing generally attaches to premises. Additional units, warehouses or kitchens need their own coverage.

How the category is decided

  • Petty food business operators

    Small operators within the prescribed turnover and capacity limits — small retailers, hawkers, itinerant vendors and small home-based operations — generally take Basic registration.

  • Turnover-based movement

    Once annual turnover crosses the limit prescribed for registration, a State licence generally becomes applicable. Higher turnover and capacity move a business towards a Central licence.

  • Installed capacity

    Manufacturing and processing units are also tested on production capacity, and for dairy and meat on the specific capacity criteria prescribed.

  • Multi-State operations

    Operating from premises in more than one State typically requires a Central licence for the head office along with State licences for the individual premises.

  • Import and export

    Importers and exporters of food articles fall in the Central licence category, in addition to holding an IEC.

  • Specified categories

    Supply to Central Government agencies, railways, airports, seaports and defence establishments, and certain specified businesses, attract a Central licence.

  • E-commerce food businesses

    Food businesses operating through e-commerce are covered by the regulations, and the applicable category depends on the model and scale.

  • Per-premises rule

    Licensing generally attaches to the premises. Additional kitchens, outlets or warehouses require their own registration or licence.

Operating on an expired licence is treated as operating without one. Renewal is planned in advance rather than on the expiry date.

  • Applying in the wrong category

    Taking Basic registration when a State licence applies is the most common error. It resurfaces during inspection, aggregator onboarding or a growth review — and usually at the worst moment.

  • Missing kinds of business

    A licence records specific kinds of business. Running a cloud kitchen on a retail registration, or storing in an uncovered warehouse, is a gap even when the number is valid.

  • One licence for many premises

    Each kitchen, outlet or storage unit generally needs its own coverage. A single number does not travel across locations.

  • Ignoring the deficiency memo window

    Deficiency memos carry a limited response period. A missed reply usually means rejection and a fresh application with a fresh fee.

  • Weak layout or capacity documentation

    Vague layouts and unsupported capacity figures delay manufacturing applications more than anything else.

  • Forgetting display and labelling

    The number must be displayed and, in prescribed cases, printed on labels. Enforcement action often starts here rather than with the licence itself.

  • Letting the licence lapse

    Renewal has to be applied for before expiry. A lapsed licence can require a fresh application and interrupts marketplace listings.
