Do you have a TDS obligation?

Deduction is triggered by payments, not by size.

Deduction generally needs to be examined where you

  • pay salaries to employees whose income is chargeable to tax
  • pay contractors, professionals or consultants for services
  • pay rent, commission or brokerage above the limits prescribed
  • make specified payments where the Act requires the payer to deduct
  • hold a TAN and have already been filing statements
  • have received a default notice or a demand for an earlier period

It may not arise where

  • payments fall below the threshold prescribed for that section during the year
  • the payee holds a valid certificate for lower or nil deduction covering the payment
  • the payment is of a category outside the deduction provisions
  • you are an individual or entity not required to deduct for that class of payment under the Act

Whether deduction applies, at what rate and under which section depends on the nature of the payment, the status of the payee and the provisions in force for the year. Thresholds and rates are prescribed and can change, so we review your payments rather than applying a fixed table.

TDS is a chain. It breaks at the weakest link.

The obligation does not end when tax is deducted. The amount must be deposited within the prescribed period, the challan must be reported correctly in the quarterly statement, the deductee's PAN must be valid so the credit reaches the right person, and the certificate must be issued so your vendor or employee can claim it. A break anywhere produces a default — often discovered months later, with interest already running.

Due dates for deposit and for quarterly statements are prescribed under the Income-tax Rules and can be revised. Your engagement calendar is maintained and updated internally rather than published as static text here.

How the obligation is determined

  • Nature of the payment

    Each deduction provision applies to a defined category of payment. The category, not the label used in your books, decides the section.

  • Status of the payee

    Whether the payee is an individual, firm, company, resident or non-resident affects the section and often the rate.

  • Thresholds

    Several sections apply only beyond a prescribed limit, measured per payment or for the year. Limits are prescribed and can be revised.

  • Rate in force

    Rates are prescribed under the Act and the Finance Act for the year, and can differ where the payee's PAN is not available.

  • Point of deduction

    Deduction is generally required at payment or credit, whichever is earlier, subject to the provision that applies.

  • Payments to non-residents

    Remittances to non-residents follow a separate regime with treaty considerations and additional reporting, and are reviewed case by case.

  • TAN requirement

    A deductor generally needs a TAN to deposit and report tax deducted. Certain property-related deductions follow a different route.

  • Consequences of default

    Failure to deduct or deposit can attract interest, late fee, penalty and disallowance of the related expenditure, depending on the facts.

  • Deducting under the wrong section

    A contractor payment treated as professional fees, or the reverse, produces short deduction demands even though tax was paid.

  • Filing with unvalidated PANs

    An invalid or mismatched PAN attracts a higher deduction requirement and generates a default the payee will also complain about.

  • Not reconciling challans before filing

    Reporting against a challan that does not match creates a short-payment default that then needs a correction statement.

  • Ignoring lower deduction certificates

    Deducting at the normal rate when the payee holds a valid certificate creates avoidable refund claims and vendor friction.

  • Depositing late and hoping it passes

    Interest for late deposit is automatic and computed for the period of delay. There is no discretion to argue away.
